We take the security and privacy of your personal and profile information very seriously. Vegan Chef Network has a Privacy Policy which should be read in conjunction with these Terms and Conditions.
The information you provide in the Membership section of the Vegan Chef Network web site includes personally identifiable information (such as your name, your email address, your residential or postal address, etc.) This personally identifiable information is never sold or shared with any third party, except:
if you expressly agree and give us permission to do so. For example, we may pass on some details to a partner of ours if it is necessary for us to process a transaction that you request us to process, and you give us consent to do so; or if it is required by law.
The information you provide in the Account Profile section of the Vegan Chef Network web site is information about you that cannot be used to identify you personally (such as your age, gender, postcode, education, background, preferences, habits, etc.) This profile information is used by us to ensure that you only receive surveys appropriate to you, and to allow us to reach the particular type of Chefs they are targeting with our survey.
The information in your Account Profile is never shared with any third party in a way that can be used to personally identify you. It is only shared with third parties on an aggregate basis. 'Aggregate basis' means the information of many members is combined together to form one measurement or quantity that cannot be used to identify any particular person. For example, a client may be told that their survey campaign is going to be received by 500 members from across Australia from Hotels, Pubs, Clubs and Restaurants.
We will take all reasonable precautions and measures to maintain the security and privacy of your personal information. This includes using the very best in hardware, software, and security practices available to us. However, due to the nature of the Internet and the nature of the systems and technology available at the current time, it is unfortunate that breaches of security are still possible. Therefore we cannot guarantee that your information will be completely secure, and we cannot be held liable for any loss or damage arising out of a breach of security.
You must keep your account password confidential at all times. You are responsible for all transactions made on Vegan Chef Network with your email and password. We are not liable for any loss or damage arising out of the unauthorised use of your email and password.
When you join the service you give us consent to send you emails, with or without any incentive or reward, that are necessary for us to continue to provide the Service to you. These emails (referred to as 'service emails') may include:
Because service emails are required and necessary for us to provide the Service to you, the only way to unsubscribe from receiving service emails from us is to terminate your use of the Service by cancelling your membership.
When you join Vegan Chef Network you give us consent to send you notifications or invitation emails (referred to as 'survey invitation emails' or 'surveys') to participate in online market research surveys. We will offer to you an incentive of reward points or entries into a competition for completing the online market research surveys, taste tests or product trials. To be eligible to earn rewards for completing a survey you must attempt the survey within a specified time frame, you must complete the survey before the quota for that survey has been met ('quota' means the maximum number of respondents to a survey), and you must meet all other eligibility requirements for that survey. Due to the nature of market research, it is usually not possible to disclose up-front what the full eligibility requirements for a survey are.
Receiving survey invitation emails is a required and necessary part of full Vegan Chef Network membership. Therefore the only way to unsubscribe from receiving survey emails from us is to terminate your use of Vegan Chef Network by cancelling your membership. We make no guarantee or representation as to the minimum number of survey invitation emails you will receive from us. The rewards offered for each survey varies, depending on the length of the survey and other factors. In addition to this, the number of rewards you are eligible to earn from a survey depends on how far you progress through the survey.
The Vegan Chef Network contains electronic message boards ('forums'), chat rooms, electronic messaging and feedback systems, and other communication facilities which allow you to communicate with us, with third parties, and with other members of Vegan Chef Network (referred to hereafter as 'Communication Facilities').
It is a condition of your use of any Communication Facility and your access to Vegan Chef Network that you do not do any of the following:
We may from time to time monitor or review the contents of the Communication Facilities. While we reserve the right to edit, delete, or refuse to post any information, content or materials (in whole or in part) that in our sole discretion are in any way objectionable or in violation of any applicable law or these Terms and Conditions, we have no obligation whatsoever to monitor any Communication Facility or to edit, delete or refuse to post any information, content or materials, nor are we responsible for any information, content or materials posted by you or any other member of the Service or user of Vegan Chef Network.
You acknowledge and agree that the Communication Facilities provide a means of public and not private communications.
We reserve the right to cooperate fully with any law enforcement authority in any jurisdiction in respect of any lawful direction or request to disclose the identity or other information in respect of anyone posting any information, content or materials which violate any applicable or relevant law.
We reserve the right to cancel any member account created with a Chef name that in our opinion is offensive, obscene, profane or indecent.
All content and material on the Vegan Chef Network web site and forum and sent to you in an email by Vegan Chef Network is protected by Brooklyn, NY and international copyright law, and may also be protected as a trademark, service mark, or under other rights and laws.
Except for the creation of a temporary copy on your computer which is inherent to the process of the normal use of Vegan Chef Network, the content and material referred to above may not be copied, reproduced, published, stored in a retrieval system, altered or otherwise used in any form or by any means, in whole or in part, without our prior written approval, or the approval of the relevant copyright owner.
You acknowledge that you have not relied upon or been induced by any representation by us and that we make no warranty or representation as to:
You release Vegan Chef Network, its parents, subsidiaries, and its officers, employees, agents and affiliates from any claim for loss, damage or liability, including special indirect or consequential loss or damage such as loss of revenue, unavailability of systems or loss of data, in respect of:

These Terms and Conditions are effective and in force until terminated by us. We may terminate these Terms and Conditions at any time without notice.
We reserve the right to cancel your membership and terminate your use of the Service at any time, without cause or reason, and without notice. Specifically, we may cancel your membership and terminate your use of the Service, without notice, if you:
We reserve the right to cancel your membership and terminate your use of the Service, with 7 days notice, if your membership account becomes inactive through non-use over a period of 12 months. To prevent your membership account from becoming inactive, it is sufficient to simply sign in to the Vegan Chef Network web site on a regular basis.
You may choose to terminate your obligations under these Terms and Conditions at any time by cancelling your membership of the Vegan Chef Network Service. This can be done in the Membership section of this web site. You will be required to enter your password in order to cancel your membership.
We reserve the right to refuse your application to join the Service again if we have ever cancelled your membership of the Service in the past.
If any part of these Terms and Conditions is or becomes illegal, invalid or unenforceable, it shall not affect the validity or enforceability of any other part or provision of these Terms and Conditions.
Except for small claims disputes in which you or Vegan Chef Network seeks to bring an individual action in small claims court located in the county of your billing address or disputes in which you or Vegan Chef Network seeks injunctive or other equitable relief for the alleged unlawful use of intellectual property, you and Vegan Chef Network waive your rights to a jury trial and to have any dispute arising out of or related to these Terms or our services resolved in court. Instead, for any dispute or claim that you have against Vegan Chef Network or relating in any way to the services, you agree to first contact Vegan Chef Network and attempt to resolve the claim informally by sending a written notice of your claim (“Notice”) to Vegan Chef Network by email at support@VeganChefNetwork.com. The Notice must
Our notice to you will be similar in form to that described above. If you and Vegan Chef Network cannot reach an agreement to resolve the claim within thirty (30) days after such Notice is received, then either party may submit the dispute to binding arbitration administered under the limited circumstances set forth above, in court. All disputes submitted will be resolved through confidential, binding arbitration before one arbitrator. In accordance with the Streamlined Arbitration Rules and Procedures.
You and Vegan Chef Network agree that these Terms affect interstate commerce and that the enforceability of this Section will be substantively and procedurally governed by the Federal Arbitration Act, (the “FAA”), to the maximum extent permitted by applicable law. As limited by the FAA, these Terms, the arbitrator will have exclusive authority to make all procedural and substantive decisions regarding any dispute and to grant any remedy that would otherwise be available in court, including the power to determine the question of arbitrability. The arbitrator may conduct only an individual arbitration and may not consolidate more than one individual’s claims, preside over any type of class or representative proceeding or preside over any proceeding involving more than one individual.
The arbitrator, Vegan Chef Network, and you will maintain the confidentiality of any arbitration proceedings, judgments and awards, including, but not limited to, all information gathered, prepared and presented for purposes of the arbitration or related to the dispute(s) therein. The arbitrator will have the authority to make appropriate rulings to safeguard confidentiality, unless the law provides to the contrary. The duty of confidentiality does not apply to the extent that disclosure is necessary to prepare for or conduct the arbitration hearing on the merits, in connection with a court application for a preliminary remedy or in connection with a judicial challenge to an arbitration award or its enforcement, or to the extent that disclosure is otherwise required by law or judicial decision.
Any claim arising out of or related to these Terms or our services must be filed within one year after such claim arose; otherwise, the claim is permanently barred, which means that you and Vegan Chef Network will not have the right to assert the claim.
You have the right to opt out of binding arbitration within 30 days of the date you first accepted the terms of this agreement by sending an email to support@VeganChefNetwork.com. In order to be effective, the opt-out notice must include your full name and address and clearly indicate your intent to opt out of binding arbitration. By opting out of binding arbitration, you are agreeing to resolve disputes in accordance with this agreement.
If any portion of this section is found to be unenforceable or unlawful for any reason, (a) the unenforceable or unlawful provision shall be severed from these Terms; (b) severance of the unenforceable or unlawful provision shall have no impact whatsoever on the remainder of this terms or the parties’ ability to compel arbitration of any remaining claims on an individual basis pursuant to this terms; and (c) to the extent that any claims must therefore proceed on a class, collective, consolidated, or representative basis, such claims must be litigated in a civil court of competent jurisdiction and not in arbitration, and the parties agree that litigation of those claims shall be stayed pending the outcome of any individual claims in arbitration. Further, if any part of this terms is found to prohibit an individual claim seeking public injunctive relief, that provision will have no effect to the extent such relief is allowed to be sought out of arbitration, and the remainder of this terms will be enforceable.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, United States of America. You submit to the jurisdiction of the courts of New York, United States of America.
If you have any question about this agreement, please do not hesitate to contact Vegan Chef Network at support@VeganChefNetwork.com or click on the contact us icon on our website https://veganchefnetwork.com/contact.

“Personal data” means any information that enables us to identify you or the beneficiary of your transaction with us, directly or indirectly, such as name, email, address, telephone number, any form of identification number or one or more factors specific to your or your beneficiary’s identity.

The information you provide to Vegan Chef Network is considered personal information. Failure to provide all information required by Vegan Chef Network may prevent access to any or all Vegan Chef Network materials, and failure to maintain accurate information may also result in suspension or termination of access to any or all Vegan Chef Network materials.
Personally Identifiable Information (PII). We acquire PII that may include, in certain contexts, your name, postal address, post code, email address, and telephone number. We also acquire your IP address, User ID, and/or Device ID, which certain jurisdictions consider to be PII because it could be used to identify an individual or device if it were combined with other identifying information.

Sensitive PII. In certain circumstances, such as when purchasing a service, you may provide a credit, debit, or payment account number, or other payment information to our payment gateway provider such as Sage Pay, Stripe and PayPal which we recognize as more sensitive than other PII. We generally do not request on or through the service other data that is often considered “highly sensitive,” such as other financial account information (e.g., credit report information, bank account numbers), or government issued identification numbers (e.g., drivers’ license number, or passport number), although we reserve the right to do so when such data is necessary to offer you certain services.
Anonymous Data. Some of the data that we acquire cannot identify, distinguish or trace you or your Device, even if combined with other identifying information, and some data that could be considered PII when combined with other identifying information is not used in a way that identifies, distinguishes or traces you or your device, but is instead used in an anonymous way, often aggregated with other anonymous data about other users.
